After the Senate, the Darcos AI Bill Faces Its True Test in the Assemblée Nationale

After passing smoothly through the Senate, the French bill on AI training data is set to enter a period of intense political turbulence in the National Assembly, amid pressure from industry, governmental hesitation, and a battle over the legislative schedule.

The Senate is poised to smoothly clear another hurdle on the bill aimed at establishing a presumption of use of works by artificial intelligence systems. Sponsored by Laure Darcos, Agnès Evren, and Pierre Ouzoulias, the bill is set to be adopted in plenary session tomorrow, April 8, following unanimous vote in committee. It aims to address the limitations of the current European framework based on the text and data mining (TDM) exception and the opt-out mechanism, which, at this stage, have not resulted in any licensing agreements. But while its passage through the Senate is virtually assured, the future of the measure will be decided in the Assemblée Nationale.
