CJEU: “Offline” Content Available on Streaming Platforms Does Not Constitute a Private Copy
The Court of Justice of the European Union clarifies that copies of works made for offline use as part of streaming services such as Spotify or Netflix do not fall under the private copying exception.
Following a request for a preliminary ruling from the Supreme Court of the Netherlands, the Court of Justice of the European Union (CJEU) was asked to determine whether copies of works (music, films) downloaded by users for offline viewing via streaming platforms could be classified as “private copies,” entitling rights holders to fair compensation….
