Applying the AI Act to generative AI: a jangling process

The European Commission has just begun the process of applying the AI Act to generative AI, involving nearly a thousand stakeholders. Many of them are complaining, whether about the cacophony of the process, the unsatisfactory content of the text itself, or the lack of representativeness.

To make the IA Act applicable – the European regulation on artificial intelligence adopted last June – the European Commission must now adopt several acts. Among them, one or more « Codes of Practice » on the specific obligations of generative AI (IAG), such as those to draw up technical documentation, as well as an internal copyright compliance policy. These codes should also help to identify IAGs that present « systemic risks », which are subject to additional obligations.
