WhatsApp: A Landmark Case of Provisional Measures by the Commission

For only the second time since the adoption of the EU Antitrust Regulation in 2003, the Commission has imposed provisional measures on a company. Pending the outcome of its substantive investigation, Brussels is ordering Meta to reopen WhatsApp to AI assistants competing with Meta AI.

On Monday, the European Commission adopted a decision that is extremely rare in its competition arsenal. As part of its investigation into Meta’s practices regarding WhatsApp and artificial intelligence, Brussels has ordered the U.S. company to restore access to its messaging service for competing AI assistants within five business days. The measure will remain in effect until the conclusion of the antitrust investigation, which is set to conclude in late 2025.
